Court Rejects Mohbad’s Father’s Bid to Overturn Legal Clearance of Naira Marley, Sam Larry.


A Lagos High Court in Ikeja has dismissed an application filed by Joseph Aloba, father of the late singer Mohbad, seeking to invalidate legal advice that led to

the release of Naira Marley, Sam Larry, and others previously accused of involvement in his son’s death.

Justice Taiwo Olatokun ruled on Wednesday that the Attorney General’s decision—executed through the Director of Public Prosecution (DPP)—to either prosecute or drop charges falls within lawful authority and cannot be overturned. As a result, the court denied all the reliefs sought by Aloba.

Mr. Aloba, who attended the court session alongside supporters of the late Mohbad, expressed disappointment at the ruling. His legal counsel, Senior Advocate of Nigeria Wahab Shittu, stated that they intend to appeal the judgment.

      Legal Background

The application was filed by Mr. Aloba on behalf of the Aloba family, naming the Lagos State Attorney General and the DPP as respondents. Aloba argued that the legal advice clearing the accused parties was premature and undermined the ongoing Coroner’s inquest into Mohbad’s cause of death. He claimed that key suspects identified in the inquest were unjustly released.

In response, the DPP’s office, via a sworn statement by legal assistant Ayinde Ibrahim, argued that the individuals in question were not acquitted but merely discharged due to insufficient evidence. The statement also noted that the Coroner and Mr. Aloba did not have access to the full criminal case file used to inform the DPP’s legal advice.

The DPP concluded that there was no evidence linking Naira Marley, Sam Larry, Prime Boy, or Opere Babatunde directly or indirectly to Mohbad’s death. This formed the basis for their release.

Although the DPP’s legal team declined public comment, Mr. Aloba’s lawyers reaffirmed their intent to challenge the ruling in a higher court.
