Lawyer Challenges Legality of EFCC, NSCDC Establishment Acts.
Legal practitioner Joshua Ijaodola has filed two lawsuits at the Federal High Court in Abuja, asking the court to declare the laws establishing the Economic and Financial Crimes Commission (EFCC) and t
he Nigeria Security and Civil Defence Corps (NSCDC) unconstitutional.
In the suits dated June 23 and filed on June 24, Ijaodola contends that both agencies’ enabling laws violate Section 214 of the Nigerian Constitution (as amended in 2018 and 2023).
In the first case (FHC/ABJ/CS/1231/2025), he named the National Assembly, the Attorney-General of the Federation, the Nigeria Police Force, and the EFCC as defendants. In the second suit (FHC/ABJ/CS/1232/2025), the same parties were named, with the NSCDC replacing the EFCC as the fourth defendant.
Supporting affidavits confirmed the suits are not duplicated or pending in any other court.
Ijaodola argued that the EFCC was improperly established by the National Assembly through the EFCC Act of 2004, which gave the commission police-like powers, including arrest, investigation, and prosecution of financial crimes. He maintains these powers constitutionally belong to the Nigeria Police Force under Section 214 of the 1999 Constitution and the Police Act of 2022.
He also challenged Section 8(5) of the EFCC Act, which he claims wrongly extends police authority to the EFCC.
In the second case, he argued that the NSCDC, created through its amendment act in 2007, was also granted powers that conflict with those legally reserved for the police.
According to Ijaodola, both agencies are performing duties that should be handled by the police and have received large amounts of public funding despite their allegedly unconstitutional foundations.
He requested that the court invalidate the acts establishing both institutions, emphasizing the importance of upholding the Nigerian Constitution.
The cases have not yet been assigned to a judge for hearing.
